New Jersey moved a step closer last week toward overhauling its unique-in-the-nation election ballots, in a decision that could reshape party politics in the state for years to come. On Saturday, the federal judge who ordered the redesign, in response to a lawsuit filed in February by three Democratic candidates, said in a statement that only the Democratic primary, which includes the race to replace Senator Robert Menendez, would have to use the new ballot. The Republican ballot, he wrote, can stay the same, though he said his order did not prohibit Republican leaders from choosing to alter their party’s ballot. The clarification is the latest twist in a long legal battle in New Jersey to shift the balance of electoral power away from party-backed candidates and open the door for newcomers in both parties. “If this decision holds, it will completely upend New Jersey politics.”

It's been three weeks since a cyberattack on an under-the-radar but critical technology company caused the payments that flow between healthcare providers and insurers to grind to a halt nationwide. Operating fourth-quarter EBITDA (earnings before interest, taxes, depreciation, and amortization) is expected to be about $715 million, operating cash flow about $640 million, and adjusted free cash flow is expected to be about $500 million. That compares to estimates, according to FactSet, of $746 million, $573 million and $447 million, respectively. These forecasts represent across-the-board misses versus Street expectations for sales of $3.04 billion, operating EBITDA of $751 million, and earnings of 88 cents per share. Given the slower recovery and impact on 2024 earnings, we are reducing our DuPont price target to $78 per share from $85.

Hollywood stakeholders and analysts alike have declared Netflix the winner of the streaming wars — but the celebration may be short-lived as streaming enters a new phase. Analysts can't say for sure how much more subscriber growth Netflix can add through its cheaper ad tier and password-sharing crackdown, though. Plus, Netflix is about to face big competition for ad dollars from Amazon, which will launch ads on Prime Video starting January 29. Also, Big Tech's ability to fund their streaming services indefinitely could keep subscription prices depressed for Netflix, along with everyone else, Bernstein noted. But now that the strikes are over, some analysts predict Netflix will face a bigger content bill going forward.
